Neighbor Rights During Demolition Work
Demolition work affects not only the property owner but also the surrounding neighborhood. Noise, dust, vibrations, and potential damage to adjacent buildings are common sources of conflict. Berlin's regulations establish clear rights and obligations for all parties involved.
Notification Requirements
Before demolition begins, property owners must notify the district office via the demolition notice (Abbruchanzeige), which also informs neighbors. Direct personal notification is recommended, along with a pre-construction condition survey (Beweissicherungsgutachten) of neighboring buildings to document their condition beforehand.
Noise and Working Hours
Berlin's immission protection regulations limit demolition work to weekdays and Saturdays from 7 AM to 8 PM, with no work on Sundays or public holidays. Particularly loud activities may be further restricted. Noise levels must stay within specified limits depending on the zoning category of the area.
Shared Walls and Boundary Structures
When demolishing buildings that share a wall (Grenzwand) with a neighbor, special obligations apply. The shared wall cannot be unilaterally removed, and the demolition must ensure the remaining wall is structurally sound and weatherproof. The demolition client bears the costs for securing the boundary wall.
Liability
Property owners and demolition companies are liable for damages caused by negligence. For particularly hazardous work, strict liability may apply regardless of fault. Neighbors who must tolerate excessive impacts are entitled to appropriate compensation under Section 906 of the German Civil Code.
